Raid on Trump’s Mar-a-Lago was illegal: WSJ op-ed

The authors of the piece, David B. Rivkin Jr. and Lee A. Casey, are Washington attorneys who served at the Justice Department and the White House Counsel’s Office in the Reagan and George H.W. Bush administrations.

Here, they refer to the Presidential Records Act OF 1978:

The PRA lays out detailed requirements for how the archivist is to administer the records, handle privilege claims, make the records public, and impose restrictions on access. Notably, it doesn’t address the process by which a former president’s records are physically to be turned over to the archivist, or set any deadline, leaving this matter to be negotiated between the archivist and the former president.

The PRA explicitly guarantees a former president continuing access to his papers. Those papers must ultimately be made public, but in the meantime—unlike with all other government documents, which are available 24/7 to currently serving executive-branch officials—the PRA establishes restrictions on access to a former president’s records, including a five-year restriction on access applicable to everyone.

They go on to note that if DOJ was worried about classified materials, they could have simply secured the materials better instead of conducting a raid. “Surely that’s what the government would have done if any other former president were involved,” they write.

  1. For those who loathe DJT, the damage is done, regardless of what is uncovered. Smearing his name is all that matters to them, and they rejoice, the bullies that they are. For those that see Trump 2024 in their magic fish bowl, this fuels the engine even more, and they rejoice at the chance to prop up their man.

    For most of the middle grounders, they think the raid was uncalled for, irrational, almost silly. We say “meh” and move on.
