In an odd twist, President Biden last month signed Ketanji Brown Jackson’s commission to serve on the Supreme Court early, before retiring Justice Stephen Breyer has left.
Last month, Senate Republican Leader Mitch McConnell said Biden should clarify that there are still nine justices, and not ten. Jackson cannot make rulings until she is sworn in, something that is traditionally done by the chief justice. The commission is usually signed at the time the new justice is sworn in.
According to the Daily Caller:
Republican Tennessee Sen. Marsha Blackburn warned Wednesday that Democrats could try to pack the Supreme Court by adding Ketanji Brown Jackson before Justice Stephen Bryer retires in an effort to stop Roe v. Wade from being overturned.
In an exclusive interview with the Daily Caller, Blackburn slammed Senate Majority Leader Chuck Schumer and said Democrats might start pushing Supreme Court Justice John Roberts to seat Jackson — President Joe Biden signed Jackson’s commission papers in April — on the court. Blackburn said Democrats dislike the idea of Roe v. Wade being overturned so much they might try to add a seat to the Supreme Court.
“In April he (Biden) did sign those commission papers appointing her to the court. And I think it’s going to be interesting to see if the left starts pushing Justice Roberts to seat Judge Jackson because they are trying to push the balance of the court. They’re trying to pack the court. They’re trying to expand the court,” Blackburn told the Daily Caller.

I just can’t see how the country stays together with this metastasizing cancer known as the democrat party. There is nothing that they will not do to further their power and control. Nothing is sacred or off-limits in their desire to destroy our way of life. One day, it’s going to go to far and then it’s game on.

Not sure placing Jackson on the Supreme Court now is possible. First, courts above the lowest courts have odd number of judges. Second, Jackson was not a participant in the oral arguments before the U S Supreme Court on this abortion issue. The oral arguments took place on DEC 1 of last year. When Justice Barrett first joined the Court, she was not allowed to participate in the decisions involving cases heard before she joined the Court.
