Experts: Trump Has the Legal Right to Build the Wall

The Washington Examiner found five legal and constitutional experts who said President Trump is within his rights to declare an emergency and build a wall on the border with Mexico.

Here’s one of them:

“The short answer to ‘Can he do it?’ is yes and ‘Can he get way with it?’ is probably yes, actually,” Kim Lane Scheppele, a professor at Princeton University’s Center for Human Values, told the Washington Examiner.

“We sort of think we live in a constitutional government in which all powers have some kind of legal constraints, but the way that the emergency powers in the U.S. are written and the history of their use indicates that basically, there is not much of a constitutional constraint on the use of presidential emergency powers,” she said. 

I have one serious concern: That President Kamala Harris or someone similar will simply declare everything a national emergency and do whatever they want.

On the other hand, after Barack Obama’s abuse of executive authority, they’ll probably do that anyway.

  1. I was hoping he could use some of Chapo’s funds as Sen. Ted Cruz suggested. You are right the Dem’s in the future will abuse the authority.

    The Dems will do it whether Trump does or not.

    Shove it down their throats. The time for playing nice is long gone.

    • Yes, our modeling good behavior hasn’t improved Dem abuse of power. IMO, Obama effected a coup by using government structure to harm Republican party. Let Trump do right and secure our border now.

  3. Trump will win… He just also needs to break the Dems… and if he stays the course he will definitely make the Dems know that you do not mess with Trump (unless you have a 2/3 majority in the House and Senate to over-ride a veto — so there is no dictator)

    He will teach them to negotiate in good faith or else he will crush them… and that is what he is doing.

    Dems cannot win….. Trump has the statistics, the common sense argument, the emotional family issue, etc on his side…

    When the Dems say.. fully open the govt… the Jeffersonians like me simply shrug and say “Why?”….. I feel bad for the people in govt not getting paid…but they are no more special than the people in the private sector that see hours cut, wages held, layoffs, benefits cut, etc…. they are free to get a job somewhere else — we have RECORD low unemployment – Companies are dying for workers, albeit legal workers.

    Hold the line Mr. President.

    • Agree. Hold the line. The fanatic Democrats have become used to bullying American Presidents and others who dare to challenge the words and actions of the loudmouth Democrats who dominate and control the tone and content of much of corporate media. Both Bushes all but caved in or didn’t know how to take them on, for the most part. The Leftist crackpot Obama was loved by the media because they held the same “America sucks and we need to destroy it” attitude Obama and Hillary held and still hold. So along comes the iconoclast Trump (who gets 90 percent negative coverage by the corporate media) and they all wet their diapers.

    • I appreciate your response on the other thread, but I digress. Does it not concern you the instructive sent out by the Arizona GOP this week? Something on lines of not tolerating anything that goes against Trump? We may get a few dissenting Republicans here and there (AK, UT, ME come to mind), but most of them are too scared to speak up. That’s scary.
