Former Top Prosecutor: Email Suggests Crime by Hillary

The latest batch of Hillary Clinton emails released by the State Department early Friday contain what may be the smoking gun that forces the Justice Department to charge the former secretary of state with a crime, according to former federal prosecutor Joseph diGenova.

“This is gigantic,” said diGenova. “She caused to be removed a classified marking and then had it transmitted in an unencrypted manner. That is a felony. The removal of the classified marking is a federal crime. It is the same thing to order someone to do it as if she had done it herself.”

On the June 17, 2011, email chain with senior State Department adviser Jake Sullivan, Clinton apparently asked Sullivan to change the marking on classified information so that it is no longer flagged as classified.

Clinton, using her private email server, asks for “the TPs,” apparently a reference to talking points being prepared for her. Sullivan, who is using his official State Department email, responds, “They say they’ve had issues sending secure fax. They’re working on it.” Clinton responds, “If they can’t, turn into nonpaper w[ith] no identifying heading and send nonsecure.”

It’s not clear if Sullivan actually followed through on Clinton’s orders. But if he did, it may expose Clinton to serious legal jeopardy.

“This makes it impossible for the bureau not to recommend charges,” diGenova said of the FBI. “This makes it impossible not to go forward, and it certainly ties the hand of the attorney general.”

Some have speculated that while the FBI may recommend charges, Attorney General Loretta Lynch might try to avoid doing so for political reasons.

The revelation also appears to put to the lie Clinton’s claim that she never handled classified information on her server.

“I did not send nor receive anything that was classified at the time,” she has claimed. By instructing her aide to send her material marked classified, it is clear that she not only may have received classified information, but that it was indeed “classified at the time.”

“This means that when she said, ‘I never received anything marked classified,’ she in fact did,” diGenova said.

David Bossie, president of the watchdog group Citizens United, said the email could become the emblem of Hillary’s email scandal.

“It proves that Hillary Clinton affirmatively instructed senior staff to send classified data to an unsecured server,” he said. “With that, it cements into history, much like the famous Bill Clinton finger wag.”

  1. OT: The Philadelphia Police Commissioner issud a statement that the offender who ambushed and shot a Philadelphia Police Officer has made a confession that his motive was that police enforce laws that are contrary to sharia law, and that he is a supporter of ISIS.

    She’s sworn in as Sec of State.
    The geeks, nerds, and computer gurus there set her up with a secure e-mail, a server(?), a what-a printer, a cell or tablet?
    She decides to go on her own, secures a company to make her own network because (?)and notifies everyone at the State Dept that she isn’t using their system.
    No one makes a peep, no one issues a warning about the law or security issues, and for four years national security items are passed back and forth.
    The point of looking for a violation of ethics or her oath passed after just one issue of something that would be classified, secret, or whatever they call it.
    The Feds don’t need a 100 or a million documents, all they need is one – they have that one, but nothing is done.
    The lies of Benghazi were discovered within two months of the incident, but Congress is still “investigating” years later.
    This issue is being drowned in trivia, in repetition until it has no meaning or reason.
    The odds of anything other than a official censure (doubtful) is about nil to none.

    • Why is Congress still investigating? Up until 10 months ago, our State department kept saying there were no emails under .gov address for “H”,Uma and Cheryl Mills.

      The person who should be held responsible is President Obama. It was his SOS (or POS) that circumvent the law, the IG Process and FOIA. The President, VP, SOD,AG,CIA had to know “H” wasn’t using the .gov addresses and they all looked the other way…………

      • It’s like exploring a cobweb. You touch one strand and all the other strands move also. These creeps are all connected to each other, like stands of the cobweb , through friendship, favors owed, blackmail possibilities, shared illegal activities, mutual secrets, etc. Touch one of them and the others will go after your throat, that’s the threat hanging in the air. That’s how Clinton and for that matter Obama (ValJar) operate. And they’re not alone. It’s the Washington code.

    • Thats what I do not understand?; NO ONE, not one career diplomat or State Dept. official for years had the NERVE or GUTS to stand up to SOS Clinton, career be damned, and say ‘This is wrong…’
      This leaves me with NO RESPECT for the State Dept. Like I have NO RESPECT for today’s Pentagon.

      • I read an article about Band of Brothers……in the article there was an interview with Elliot Richardson. AG Richardson was the AG go against Nixon.

        Richardson was on the beach at Normandy being shelled by the German guns that Easy Company of the 506 PIR took out of commission. Richardson never knew who stopped the guns that day. He stated he would not have gotten off the beach. The courage from Easy Company gave Richardson courage 30 years later………

        We need more courage ……..everyone is more concerned about keeping their pensions than their country.

    Pennsylvania, Michigan. One town in PA (over 2.5 years) taken over by Muslims.

    Some of this is old news, but it is continuing and the Obama administration continues to populate the US, changing our demographic and our voting base. The fact that UPS under contract to transport these people is really offensive.

    And this is how towns get taken over by Muslims — in Pa. and in Michigan.

          • No or little notification re hundreds, thousands of immigrants coming into your town is SOP. Plop, one day they are here. Now the community has to figure out how to house them, how to feed them, sign them up on welfare programs, get them cars (yes, they do get cars), get hundreds of new kids into the already crowded schools, figure out how the hospitals are going to treat their ill, readjust the mill rate in the tax code to pay for all this. It’s a giant mess. And speaking of medical care, in our town (5,000+ Muslims), the imans demand that no male physician treat their women . Only female physicians may touch them. So, if a Muslim woman comes into the Emergency Room with a serious condition, and there is no female physician at duty at the time, one must be called in to help. Period. They threaten to sue this hospital if this is not done. And we pay for it all.

            Don’t get me started.

  4. Another 41 foreign borne with ties to terrorism. I went to check this out — brings total since 2014 to over 100 — further investigation of blocked by WH.

    But what was really interesting was the entire left hand column of articles almost all Hillary — almost all damning — and one about an Obama donor arrested in Houson for corruption charges. Of course, that could be Valjar unhappy with a donor and showing him the what’s what. But we’ll never know.

    Anyway, check out the 41 and glance at the right hand column and you will be asking yourselves, like now, what is that woman doing walking around free no less running for President?

  7. Gov. Abbot calls for a Convention of States. It’s about time to take this seriously and not talk about all the reasons why it cannot be done and we continue to be ruled by the federal bureaucracy and corrupt politicians. As Marcus has pointed out in his own town, more than once, they have lost the ability to call the shots — the citizens purpose now is to make the Muslims more comfortable in our own country — by accommodating their way of life. Not ours. This is BS.

    • At some point, and it won’t happen while the Boy King is in office, we are going to have to marshal all our resources and once and for all clean up this ISIS mess in our country. There’s no other way. Obama’s FBI director states plainly that there are ISIS cells in all 50 states. They are here and they aren’t here to learn how to quilt or collect stamps. They are here to kill us. They are here to spread the caliphate.

      We would have been far better served if the ISIS presence in the US, and what we are doing about it, had been the topic of the discussion on CNN.

You can’t compare what Hillary Clinton did with Classified E-mail, also taking money from terrorists, letting the Ambassador go down in flames without help after he begged and begged her thousands of times by e-mail for help and taking money from terrorists in the Middle East for her phony foundation and we know that the Justice System is a puppet show for Obama and not a real Justice Department anymore with Lynch — Hillary Clinton is so like a scam artist and she’s allowed to run for Pres?

    • Yes, for Muslums, contact with dog saliva requires ritual washing before prayers.
      Muslims can and do have outdoor dogs for hunting – they resemble greyhounds.
      Three stories about dogs in the Middle East:
      1. I told some young Muslim women in the ME that we had two dogs as pets in the house.
      One of the young ladies whispered, “Dogs’ saliva causes flesh eating bacteria.”
      I said, “What?!?! My dogs lick me and I have never had flesh eating bacteria.”
      She nodded vigorously and replied, “Oh yes, it is true.”
      I said, “Who told you that?”

      Apparently one of the segments of the oprah show featured a woman on her whose face was eaten where her dog had licked her.

      2. We had our dogs with us in the ME – two small white fluffy dogs. Depending on the level of their “religious” beliefs, some adults would pet them and every single Muslim wanted their picture taken with them – and children were always allowed to pet them. Aways.
      3. I was told that there is a story in the Koran of a dog being rescued from a well by the Prophet. I did not read that story so I can’t vouch for it.

      • Very interesting. Sometimes when I walk my yellow lab in a local park, there are Muslim kids playing. They look at my dog and you can just see they want to pet it and do the fun things kids do with dogs. I was once asked “Can he do tricks?” (he can) Sometimes they approach the dog to get closer, but never with less than 10 feet or so. I tell them it’s ok, the dog is very gentle, etc. (The dog loves kids) But they won’t touch him. Very sad, really.

  10. Good morning! I read an interesting report last night that Obama wants to be UN Secretary General. The article links to comments Obama made at West Point in 2014, so he’s been planning this for a while. Meanwhile, Netanyahu is working to keep him out of the UN. I hope Netanyahu is successful!

    • Yep. Saw this one coming. Obama’s handlers are working 24/7 to make this happen. They want their puppet to be King of the World. As you suggest, it will be interesting to see how other countries react to his nomination (or whatever you call it) to be Secretary-General. I suppose they’ll all get paid off in some way to pave the way for the Prince of Pretzels to get the position. We’ll see.

      Lord only knows how much $$$ he has been slipping to his third world pals for the past 7 years.
      Who can ever forget the spectacle of 60 or so dictators from Africa showing up at the WH with their hands out. Obama greased their palms – big time.

      His un-Constitutional actions in Libya were intended to show how he hated Congress and America but they backfired with ISIS now gaining a stronghold in Kurt.

      Netanyahu has no sway. We need to pull out of the UN, move the bldg. to a third world country, and tell Obama to go to h*ll. He never was ‘one of us’ regardless of where he was born.

      • Lefty, mostly. post 1960’s hangovers hurt it a lot, well connected to Democrat interests, confused, editorially, sometimes, desperately trying to stop losing revenues from dropping readership–dropping 5-7 percent annually in readership for the past few years. Will Jeff Bezos/Nash Publishers ownership help? Probably not. They have about 400,000 +/- sales and now rank #7 in circulation, far, far behind, USAToday which is about 4 million. They are nowhere near the newspaper they used to be when James Russell Wiggins was editor, for example.. They do win their share of Pulitzer Prizes, for whatever that’s worth these days. My opinion only, worth about a dime. ;+}

          • I used to write for the thing occasionally…incl a farewell to DC story when I moved to AZ. I used to live by the Post, but now it’s so slanted, everyday clickbait and hatebait on Republicans, the predictable crap by Eugene Robinson, Capehart, etc. I click, but it’s not the paper it used to be… Neiher is the AZ Republic (Gannett)–shifted left, has a wretchedly bad cartoonist, mostly restreads from USA Today… Newspapers–I miss you and weep for you. I take no papers now. Twenty yrs ago could never have imagined that in a million yrs.

          • Star…agree completely. I mentioned James Russell Wiggins (you surely knew him or are aware of him). He came to Maine after his WP and Ambassador gigs,and bought a little known and generally mediocre Maine newspaper called the Ellsworth American. In no time, he flipped it into the most interesting, best written and edited paper you could imagine. Circulation went through the roof. I met him a few times at various meetings and once asked him what he thought of the “new ” Washington Post, post his editorship. His response? “I’m sick about it.”

          • Wiggins I am sorry to say does not stand out in my mind but your observations are interersting…Ben Bradley, yes, and that crew. But they covered up for Kennedy’s antics. Dunno about the press sometimes–it’s all spin now. We used to actually interview people, see where a story went, not write it first and then find the people to say what fit it. I actually had editors in the past say, “Can’t you find someone who thinks this is stupid or who loves this.” Pre-vet the sources in other words…

      I suspect the Police Commissioner will be looking for a new job shortly.

        I blame an apathetic media. For instance, a “muslim lady in a hijab” was escorted out of the Trump rally in SC last night. Was it because she was muslim or wore a symbol of the Holocaust ? You decide ;) But CAIR didn’t miss a beat issued a scathing memo demanding the Trump camp apologize.

        That’s not the whole story, she was allowed in and sat silently for most of the rally then slapped the star on her chest and stood up and was taunted. Then removed. If you’ve ever been to a political rally, it’s what happens.
