Obama to Ignore Order to Appear in Atlanta Court

President Obama will ignore an order by an Atlanta judge to appear in court Thursday for a hearing in a case challenging his qualifications under the Constitution to be president.

According to the White House, Obama will continue with his current trip out West, starting the day in Las Vegas and then continuing on to Buckley Air Force Base in Aurora, Colorado before heading to Detroit where he will spend the night.

The Associated Press reported last week that the judge had denied a motion to quash a subpoena for the president to show up for the hearing, which is scheduled for 9 am ET. Obama may still be sleeping – it will only be 6 am in Las Vegas.

The case centers on whether Obama, whose father was Kenyan, qualifies as a “natural born citizen,” as required of a president under the Constitution. Some contend that “natural born citizen” means both of a presidential candidate’s parents must be U.S. citizens.

The Atlanta lawsuit would deny Obama the right to participate in the March 6 Georgia Democratic primary, though backers of the suit clearly hope to establish a precedent that would help make a national issue over whether Obama can serve as president.

A letter apparently sent by Obama attorney Michael Jablonski Wednesday to Georgia Secretary of State Brian Kemp asks Kemp to “bring an end to this baseless, costly and unproductive hearing by withdrawing the original hearing request as improvidently issued.”

Jablonski states that while waiting for Kemp to do as requested, “we will, of course, suspend further participation in these proceedings, including the hearing scheduled for January 26.”

A letter that appears to be from Kemp to Jablonski rejects the demand and holds out the threat of punitive action should Obama and his attorneys withdraw from the proceedings.

“To the extent a request to withdraw the case referral is procedurally available, I do not believe such a request would be judicious given the hearing is set for tomorrow morning,” the Kemp letter states. “Anything you and your client place in the record in response to the challenge will be beneficial to my review of the initial decision; however, if you and your client choose to suspend your participation in the OSAH proceedings, please understand that you do so at your own peril.”

I possess copies of both the Jablonski and Kemp letters, and I have little doubt that both are genuine, but I have not as of late this evening been able to contact officials to absolutely confirm their authenticity.

UPDATE: Obama and his attorneys skipped the hearing. Also, the Jablonski and Kemp letters are genuine.

Actually, his last name was only changed to Soetoro after being adopted by his Indonesian step-father. So that name would not appear on any birth certificate.

Actually, it would. I was adopted at age 9 by my step father. My birth name does not show on my birth certificate, it shows my step father as my birth father as if he really was, and I can NO LONGER even GET my original birth certificate w/ my birth name (I do have a copy already). That’s what happened w/ Obama. His first BC would show Obama, his TRUE BC however, should show Soetoro. He released the wrong fake. He’s a fake and a fraud and I really pray the Judge sees it, esp since Obama didn’t appear. Guess he was too busy campaigning and had HAS to get to the golf course later….

It is true. When we adopted our son at the age of 4, his last name was changed on his birth certificate to show our last name, not that of his birth mother.

You are absolutely correct….we adopted two boys and their birth certificates have our names, not the names of their original father or mother for that matter. We have copies of the original bc’s however, the originals are null and void with the issuance of the new birth certificates. Not sure if Barry’s adoption by his Indonesian Muslim father was formal with similar paperwork or not.

I hate Obama as much as the next guy and also think he was born in Kenya but what you just posted makes no sense Steven. He was born Barack Hussain Obama after his fathers Kenyan name.

Obama’s last name didnt change to Soetoro until he went to Indonesia and his mother married some Indonesian guy whose sir name was Soetero. How could his Kenyan birth certificate possible have an Indonesian name from 5 years in his future?

Help me reconcile these inconvenient facts please?

When you are ADOPTED, as I AM, your birth records are CHANGED. My Birth Cert has my ADOPTED PARENTS listed as my PARENTS. PERIOD. I was born in the 60′s. Same as Obama. My race however was NEGRO, not “AFRICAN’ which is what Obama’s PC do-over BC says. That’s how you know it’s fake. Just MAGNIFY it! You don’t have to open it in Illustrator or Photo Shop, just download it and MAGNIFY IT and LOOK AT THE SERIAL NUMBER 109641 and look at the ONE, it OBVIOUSLY comes from another DOCUMENT!

With all due respect, wouldn’t whether or not birth certificates are changed upon adoption depend on the laws of the country in which they originate?

I admit that I don’t know your full story, but it sounds like your experiences are wholly within the realm of the American legal system.

As for the birth certificate that BHO has “released”, I remember reading not long ago that a gentleman claimed it was faked and as proof offered up the fact that the copy he created himself was the copy that was produced by the White House. I’d be interested to see how this case turns out.

I have observed the “evidence” that this administration has put out regarding his birth certifficate and I have seen better fraudulent documents done by high school students. Some people believe that both parents have to be a U.S. citizen for someone to be a natural born citizen. I would suggest some heavy reading of a high school government textbook. You’ll find the answer is no.

Minor vs Happersett has nothing to do with natural born citizens, it only held that the constitution did not grant citizens a right to vote. The only mention of the debate as to whether or not natural-born citizens must have both parents be citizens or if it doesn’t matter as long as they are born on American soil, or territories. It does not deal with that debate as it was not at issue in this case. I hope you are not a lawyer as your ability to read decision is lacking intelligence.

You know what else was not at issue in a case, supposedly? Judicial Activism. You see, placed in ditka or in passing- or even in the majority opinion summary by a clumsy clerk- ginaallows for it to become a law or tradition. Even if the oril ruling wasn’t sound and based in the Constitution, if the original ruling was believed to be a certain way and a subsequent ruling was based on the belief in this certain way of the original ruling, it becomes indoctrinated into law. A great example is the Marbury v. Madison case where the SCOTUS stated they couldn’t rule on it, but defined judicial activism in the ruling- that allowed them to rule on similar cases in the future, because their ditka stated they could. Nobody questions whether the rulings are based on the “three paragraphs that actually deal with the case”; the entire majority opinion can be used for case precedent in future proceedings. As a matter of fact, the fact that Corporations became equal (or more equal in some cases) is credited to an error by a law clerk that was then used for future opinions.

Now, in Happersett, the SCOTUS indeed defines what makes a natural-born citizen; as a matter of fact, they go so far as to explain where the term “natural-born citizen” came from and why it is in our Constitution being worded as such. What I have to say to you is, SCOTUS rarely dismisses previously rulings made by itself. They would then state that “although it didn’t have anything to do with the case, apparently, being argued in front of them, it would be difficult for us to state that natural-born citizen was never defined by the courts.”

We may as individuals earn different wage amounts but the foundation of our country was based on all people being equal. To believe that America has a class structure is to advance a socialist concept that is intended to divide us and conquer us.

I highly recommend you read the PDF at this link before making that assumption. It is a highly detailed explanation of why both parents must be US citizens at the birth of the child for the child to be eligible for the office of President. The PDF is 200+ pages long, but only the first 50 or so are the meat of the document…the rest are supporting documentations.

There is nothing special about BHO. He is currently the last on a list of other candidates that have had their eligibility status questioned. It would be nice, perhaps even beneficial, to get an ‘official’ ruling, so this insanity can stop.

To define a term is to indicate the category or class of things which it signifies. The Supreme Court of the United States has never applied the term “natural born citizen” to any other category than “those born in the country of parents who are citizens thereof”.

I don’t doubt BHO was born in HI. But, that does not answer the question of ‘natural born’ status, since BHO admits his father was a Kenyan under British rule, at the time of BHO’s birth. Nor does BHO’s use of a SSN issued in CT, give any real indication of ‘natural born’ status. Asking questions surrounding these issues is reasonable…and expecting a truthful answer is equally reasonable.

The Venus, 12 U.S. 8 Cranch 253 253 (1814):

…“The citizens are the members of the civil society; bound to this society by certain duties, and subject to its authority, they equally participate in its advantages. The natives or indigenes are those born in the country of parents who are citizens. Society not being able to subsist and to perpetuate itself but by the children of the citizens, those children naturally follow the condition of their fathers, and succeed to all their rights.

Shanks v. Dupont, 28 U.S. 3 Pet. 242 242 (1830):

Ann Scott was born in South Carolina before the American revolution, and her father adhered to the American cause and remained and was at his death a citizen of South Carolina. There is no dispute that his daughter Ann, at the time of the Revolution and afterwards, remained in South Carolina until December, 1782. Whether she was of age during this time does not appear. If she was, then her birth and residence might be deemed to constitute her by election a citizen of South Carolina. My degree is in Social Sciences. I lack 4 credits from a full history major.

Anyway, I remember discussing the reasoning behind “natural born”. I was told by my history prof (one of the best in the NW) that the founders wanted to make sure that Presidents would never have divided allegiances . . . therefore, the requirement of both parents to be US citizens. I know there has been litigated when a candidate was not born on US soil and there is now a precedence for that. However, this probably is the first time “natural born” based on the citizenship of parents is based.

Doesn’t sound like this judge is going to play any games. Now, we will see if a suit against a sitting President is allowed.

”Original” there you have it…the Founders wanted to ensure that Presidents would not have a divided allegiance…plain and simple. Now you’d think that someone who touts himself as a Constitutional expert would have been well aware that he was not eligible for POTUS. However, this shows conspiracy and collusion on a massive scale in the highest levels of Govt, political parties (BOTH) and the msm. I do not beleive that this is the first time this question has arisen in and decided in favor of the Constitutions intent that to be eligible ones parents must BOTH be American Citizens at the time of ones birth.
The ”usurper” in the White House is a fraud and should be impeached. But, don’t hold your breath…

Chester Arthur was not eligible for the office of President. It only came out after he was already out of office, so there was no need to remove him.

Jefferson and Jackson were “grandfathered in” under Article 2 of the Constitution.

Buchanan’s father was born in Ireland but it is not clear if/when he became a US citizen – the rules were a lot more lax in those days. So he may or may not have been eligible.

Arthur would be ineligible but that was only discovered after his term so the issue was deemed moot EXCEPT that it does support the contention that Obama is not eligible because of his father’s nationality.

Wilson’s mother would have become a US citizen automatically on marriage to his father as was the ruling at the time so he was eligible.

Hoover – same as above. The automatic citizenship through marriage was in effect until 1922. So he too was eligible.

That leaves Obama who seems to fall into the same category as Chester Arthur and as such would seem to be ineligible.

1] The Founding Generation was exempted from the natural born requirement by the “Grandfather Clause”, ….”…or a Citizen at the adoption of the Constitution…”

2] The foreign birth of a parent is NO bar as long as they NATURALIZED prior to the childs birth.

Use a little logic, reason and intellectual honesty and quit reading talking points…………………

Portia…wake up. I live in the south and most of my neighbors are from the Northern states. There are a few of us natives left, but I would guess we are now a minority. Most of them wouldn’t move back north for anything. My northern friends are worried that the southern lifestyle and culture are disappearing. You give all indications that you have only been exposed to own little section of the country, and are unqualified to pass judgement on other parts. I regularly visit places all over the USA, and have lived in the north, south, northeast, midwest,southwest and currently the southeast. Trust me, the southeast has more to offer than any other part. BTW, I was born in the northeast.

If Obama refuses to show up for Court a Warrant for his Arrest should be issued at once.
It’s the Law and the Law we all live by.
NO one is above the Law.

If your supenad you show up, Period.

I will be contacting the White House to request the President follow the Law or turn himself in.

She was fought in court and lost.

What does this tell you about the authenticity of that 19 layer computer created BC?!?!?!

If it was real, why did they deny her access to such an innocuous document when she had a subpoena for it?

NO HARD COPY EVER EXISTED… Before the internet release from the WH, the HI GovM took one month and said he couldn’t find it.

If Chester could be president, so can Obama. Same circumstances apply to both men. I don’t even know how this particular case can even be an issue. I have no idea why journalist never bring up Chester Arthur when talking about this.

Chester A. Arthur was born in Fairfield, VT, therefore he IS a natural born citizen. Our current POTUS can’t prove where he was born. If born in Hawaii, why couldn’t they find his birth certificate? Althought Chester Alan Arthur’s fater was a british subject, his mother was an American who was old enough to transfer her citizenship to her son. At the birth of Chester Arthur, Malvina Stone Arthur was 27 (plus 5 months, 7 days including the birth date) and lived in the US for more than 5 years.

You leave out several key components of the Chester Arthur story, conveniently it appears. Chester Arthur was elected as VP for James Garfield in 1881. Arthur was not elected President of the US, rather was sworn into office some 200 days into his tenure as VP when Charles J. Guiteau assassinated Garfield on July 2, 1881. Arthur was president thru 1885, and was never elected to the Presidents office by a US electorate. The Arthur/Obama comparison is not apples to apples in my opinion.

All presidents born after 1787, except for Chester Arthur and Barack Obama, met the “natural born Citizen” criteria, i.e., born on U.S. soil to a mother and father who were themselves U.S. citizens at the time of the President’s birth. Neither Arthur nor Obama were “natural born Citizens” at the time of birth. Arthur was born to an alien father who also made his U.S. citizen mother an alien. Obama was born to a non-U.S. citizen father who never became a U.S. citizen and, being here only on a temporary student visa, was never even an immigrant. There have been 46 Americans that have served as Vice-President (not including Mr. Biden). Ten were born before 1787. All Vice-Presidents born after 1787, except for Chester Arthur, met the “natural born Citizen” criteria. Fourteen Vice Presidents have gone on to be President.

Natural born citizen should be the basis of the whole argument over Obama’s qualifications. It has nothing personal to do with Obama. It was designed by the Founding Fathers for a reason and that had to do with loyalty. The Commander-in-Chief leads the military in war and a person born of parents from different nations can cause a conflict in allegiance. Obama, and anyone else for that matter, is not constitutionally qualified based on where one of the parents are from. The Congress failed in its responsibility to properly certify the candidate as eligible to run for president. This national embarrassment has as much to do with Congress dropping the ball as it does Obama wanting to run for president.

I believe he should be charged with failure to appear if he simply ignored the order, or his request was insufficient.

However, if his attorney’s request is lawful and was sufficient to legally not appear, then he is fine.
